Welcome to zestdelites.com (the "Site"), operated by Robust Ventures LTD ("Robust Ventures," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the Site and your purchase of Zest Delites and Zest Delites+ products ("Products").

PLEASE READ THESE TERMS CAREFULLY. SECTION 15 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT HOW DISPUTES ARE RESOLVED. YOU MAY OPT OUT OF ARBITRATION AS DESCRIBED IN SECTION 15.

1. Acceptance of These Terms

By accessing or using the Site, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy and Shipping & Returns Policy, which are incorporated by reference. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order or create an account. By using the Site, you confirm that you meet this requirement. We currently sell and ship Products to customers in the United States only.

3. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Changes apply only to use of the Site and orders placed after the update is posted. Your continued use of the Site after that means you accept the updated Terms.

4. Product Information and Allergens

We try to describe our Products, ingredients, nutrition information, and images as accurately as possible. However, recipes, packaging, and suppliers may change, and product images are for illustration only. Always read the label on the Product you receive before consuming it, including ingredient, allergen, and storage information. Some of our Products may contain or be produced in facilities that also handle common allergens such as tree nuts, peanuts, soy, milk, wheat, and sesame. If you have a food allergy or sensitivity, check the label carefully and contact us with any questions before purchasing.

5. Health and Nutrition Disclaimer

Content on the Site, including product descriptions, blog posts, and fueling or nutrition tips, is for general informational purposes only and is not medical, nutritional, or dietary advice. Our Products are not intended to diagnose, treat, cure, or prevent any disease. Consult a physician or qualified health professional before changing your diet or exercise routine, or before using sports nutrition products, especially if you are pregnant or nursing, have a medical condition, or take medication. Zest Delites+ products are designed for adults engaged in physical activity and should be used as directed on the label.

6. Orders, Pricing, and Payment

Orders. Your order is an offer to buy. We accept your order when we ship it. We may refuse, limit, or cancel any order, including for suspected fraud, unauthorized or reseller purchases, or errors in Product or pricing information. If we cancel an order after you have been charged, we will issue a full refund.
Pricing. Prices are listed in U.S. dollars and may change at any time. If a Product is listed at an incorrect price, we may cancel orders placed at that price.
Taxes. Applicable sales taxes are calculated and added at checkout.
Promotions. Discount codes and promotions (such as multi-item discounts) are subject to their stated terms, may not be combined unless stated, have no cash value, and may be changed or ended at any time.
Payment. Payments are processed by third-party payment providers. By submitting payment information, you confirm that you are authorized to use the payment method.

7. Shipping and Returns

Shipping, delivery, cancellations, and refunds are governed by our Shipping & Returns Policy. Title to and risk of loss for Products pass to you when we deliver them to the carrier.

8. Accounts

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please notify us immediately at hello@zestdelites.com if you suspect unauthorized use. We may suspend or close accounts that violate these Terms.

9. Your Content and Feedback

If you send us reviews, comments, photos, suggestions, or other content (including by tagging us on social media), you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and adapt that content in connection with our business and marketing, subject to our Privacy Policy. You confirm that your content is truthful, belongs to you, and does not violate anyone's rights or any law. We may remove any content at our discretion.

10. Intellectual Property

The Site and all of its content, including the Zest Delites and Zest Delites+ names, logos, product designs, text, images, and videos, are owned by or licensed to Robust Ventures and protected by intellectual property laws. You may use the Site for personal, non-commercial shopping only. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written permission.

11. Prohibited Uses

You agree not to:

use the Site for any unlawful or fraudulent purpose;
purchase Products for unauthorized resale;
interfere with or disrupt the Site's security or operation, or upload viruses or malicious code;
use bots, scrapers, or other automated means to access the Site or collect data from it;
impersonate any person or misrepresent your affiliation with anyone; or
post false, misleading, or infringing reviews or content.

12. Third-Party Services and Links

Orders are fulfilled using third-party services, including Amazon's fulfillment network, and the Site may contain links to third-party websites and social media platforms. We are not responsible for the content, policies, or practices of third parties, and your use of their services is governed by their own terms.

13. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN THESE TERMS AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ROBUST VENTURES AND ITS DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE OR FOR FRAUD.

15. Dispute Resolution and Binding Arbitration

Informal resolution first. If you have a dispute with us, please email hello@zestdelites.com with a description of the issue and the relief you are seeking. We will try to resolve it informally within 30 days.

Agreement to arbitrate. If the dispute is not resolved within 30 days, you and Robust Ventures agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any Product will be resolved by binding individual arbitration, rather than in court. However, either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court for infringement of intellectual property rights.

Arbitration rules. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (available at www.adr.org). The arbitration will take place in the county where you live or by video conference, unless both parties agree otherwise. Payment of filing and arbitrator fees will be governed by the AAA's rules. The Federal Arbitration Act governs this Section.

Class action waiver. YOU AND ROBUST VENTURES AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims of more than one person or preside over any class or representative proceeding.

Right to opt out. You may opt out of this arbitration agreement by emailing hello@zestdelites.com within 30 days after you first accept these Terms, with the subject line "Arbitration Opt-Out" and your name and the email address associated with your account or order. Opting out will not affect any other part of these Terms.

Severability. If the class action waiver is found unenforceable for any claim, that claim must be severed and brought in court, and the remainder of this Section will continue to apply.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules, and by the Federal Arbitration Act. For any claim not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in Delaware, except where your state's consumer protection laws give you the right to bring a claim in your home state.

17. Indemnification

You agree to indemnify and hold harmless Robust Ventures and its directors, employees, and agents from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.

18. Termination

We may suspend or terminate your access to the Site at any time if you violate these Terms. Sections that by their nature should survive termination, including Sections 9, 10, and 13 through 19, will survive.

19. General

These Terms, together with the policies referred to above, are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. We may assign these Terms; you may not assign them without our consent. We are not liable for delays or failures caused by events beyond our reasonable control.
